Please read these terms and conditions ("Agreement") carefully before purchasing and using our GPS tracking systems ("Product") from Geo Guard. This Agreement sets forth the terms and conditions under which you ("Customer") may use our Product.
Disclaimer of Liability Geo Guard's Product is intended to provide an aid to locate and track vehicles, boats, and motorcycles. However, we cannot guarantee that the Product will always be accurate or reliable. Our Product relies on the availability and quality of 4G and Satellite signals, which can be affected by various factors beyond our control, including weather conditions, obstructions, and technical issues. Therefore, we disclaim any liability for any loss or damage that may result from the use or inability to use our Product, including but not limited to any damages for lost profits, loss of use, or other consequential or incidental damages.
Limited Warranty Geo Guard warrants that the Product will be free from defects in material and workmanship for a period of one year from the date of purchase. This warranty does not cover any damage caused by misuse, abuse, negligence, or accident, nor does it cover any damage caused by 4G or Satellite signal issues. If the Product is found to be defective within the warranty period, Geo Guard will repair or replace the Product at our discretion.
Ownership and License Geo Guard's Product and all related intellectual property rights are owned by Geo Guard. We grant to you a limited, non-exclusive, non-transferable license to use our Product for your personal or business purposes only, subject to the terms and conditions of this Agreement. You may not sublicense, assign, or transfer your license to any third party.
Data Privacy Geo Guard collects and processes personal data from our Customers for the purpose of providing our Product and support services. We will only use and disclose such personal data in accordance with our Privacy Policy, which is incorporated into this Agreement by reference.
Indemnification You agree to indemnify and hold Geo Guard harmless from any claims, damages, liabilities, or expenses (including reasonable attorneys' fees) arising out of or related to your use or misuse of our Product, or any violation of this Agreement or applicable law.
Limitation of Liability Geo Guard's liability under this Agreement shall be limited to the amount you paid for the Product. In no event shall Geo Guard be liable for any indirect, special, incidental, or consequential damages arising out of or in connection with this Agreement or the use or inability to use our Product.
Governing Law and Jurisdiction This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Geo Guard is located, without giving effect to any conflict of law principles. Any disputes arising out of or in connection with this Agreement shall be resolved in the courts of the jurisdiction in which Geo Guard is located.
Changes to this Agreement Geo Guard reserves the right to modify this Agreement at any time. Any such modifications shall be effective immediately upon posting of the modified Agreement on our website. Your continued use of our Product after any such modifications shall constitute your acceptance of the modified Agreement.
By purchasing and using Geo Guard's Product, you acknowledge that you have read and understood this Agreement, and agree to be bound by its terms and conditions. If you do not agree to this Agreement, you may not purchase or use Geo Guard's Product.
