Terms and conditions
Please read these terms carefully before purchasing and using our GPS tracking systems.
These terms and conditions ("Agreement") apply when you ("Customer") purchase and use GPS tracking systems ("Product") from GeoGuard.
Disclaimer of liability
GeoGuard's Product is intended to help locate and track vehicles, boats and motorcycles. We cannot guarantee that the Product will always be accurate or reliable. The Product relies on the availability and quality of 4G and satellite signals, which can be affected by factors beyond our control, including weather, obstructions and technical issues. We therefore disclaim any liability for any loss or damage that may result from the use of, or inability to use, the Product, including but not limited to damages for lost profits, loss of use or other consequential or incidental damages.
Limited warranty
GeoGuard warrants that the Product will be free from defects in material and workmanship for one year from the date of purchase. This warranty does not cover damage caused by misuse, abuse, negligence or accident, or issues caused by 4G or satellite signals. If the Product is found to be defective within the warranty period, GeoGuard will repair or replace it at our discretion.
Ownership and licence
GeoGuard's Product and all related intellectual property rights are owned by GeoGuard. We grant you a limited, non-exclusive, non-transferable licence to use the Product for your personal or business purposes only, subject to this Agreement. You may not sublicense, assign or transfer your licence to any third party.
Data privacy
GeoGuard collects and processes personal data from Customers to provide the Product and support services. We will only use and disclose personal data in accordance with our Privacy Policy, which forms part of this Agreement.
Indemnification
You agree to indemnify and hold GeoGuard harmless from any claims, damages, liabilities or expenses (including reasonable legal fees) arising out of or related to your use or misuse of the Product, or any breach of this Agreement or applicable law.
Limitation of liability
GeoGuard's liability under this Agreement is limited to the amount you paid for the Product. In no event will GeoGuard be liable for any indirect, special, incidental or consequential damages arising out of or in connection with this Agreement or the use of, or inability to use, the Product.
Governing law and jurisdiction
This Agreement is governed by the laws of the jurisdiction in which GeoGuard is located, without regard to conflict of law principles. Any disputes arising out of or in connection with this Agreement will be resolved in the courts of that jurisdiction.
Changes to this Agreement
GeoGuard may modify this Agreement at any time. Changes take effect as soon as the modified Agreement is posted on our website. Continuing to use the Product after a change means you accept the modified Agreement.
By purchasing and using GeoGuard's Product, you acknowledge that you have read and understood this Agreement and agree to be bound by it. If you do not agree, you may not purchase or use the Product.
